摘要
人类冷冻胚胎是人工辅助生殖技术发展的产物,南京"人类冷冻胚胎继承纠纷案"使人们开始正视其继承问题。明确人类冷冻胚胎的法律性质,是分析其是否具有可继承性的先决条件。从其自身特性出发,人类冷冻胚胎应当属于包含人格利益的特殊之物。为了保护胚胎的生命尊严及其亲属的人格利益,应当肯定其具有可继承性,并且据此确定具体的继承法律规则。
Human frozen embryo is the product of artificial assisted reproductive technology, and the case of ＂Human Embryonic Inheritance Dispute＂ in Nanjing aroused people＇s awareness of its inheritance. Making clear the legal nature of human frozen embryo is a precondition to determine its inheritability. Starting from its own characteristics, frozen embryo is a special thing with personality interests. In order to protect the embryo＇s life dignity and its kinsfolk＇s personality interests, we should affirm its inheritability, and accordingly identify specific inheritance regulations.
