在以网络为代表的新媒体背景下,缘于媒体专业能力和法学素养等基本素质欠缺,物质、政治和社会利益的束缚和驱动,以及媒体和司法专业之差异,媒体在公案报道时往往失之公正,流于偏颇,从而带来扭曲公案事实,掩盖公案真相,干扰司法审判,破坏司法公正,误导社会舆论,激化社会矛盾等不良社会影响。针对这些问题,媒体要夯实基础,加强行业自律,投身实践,不断提升自身基本素质;要恪守传媒职业规范,冷静、独立、公正地进行公案报道,坚持无罪推定,不做媒体审判;要正确看待和区分客观事实和法律事实,注意原被告之间、各类民意之间、民意和司法之间、媒体与司法机关之间的平衡;要坚持正确的舆论导向,促进社会和谐。

In order to solve these problems, the media must reinforce the foundation, strengthen professional self-discipline, join the practice, improve the basic quality constantly, clarify the responsibilities of the news attention and supervision by public opinion, abide by the media professional norms, present calm, independent and impartial legal ease reports, adhere to the principle of the presumption of innocence, avoid trial by the media, distinguish the objective facts from the legal facts, strike a balance between the plaintiff and the defendant, all kinds of public opinion, public opinion and justice, media and judicial authorities, stick to the correct orientation of public opinion, and promote social harmony.
