A Comparative Study of Children Born Out of Wedlock Voluntary Claim System

非婚生子女认领制度是亲子法领域确立非婚生子女与其生父母间亲子关系的一项重要制度,但我国婚姻法尚未对这一制度进行确认,为了完善我国的亲子法体系及保护非婚生子女的合法权益,我国应在借鉴域外国家和地区相关立法的基础上构建自己的非婚生子女自愿认领制度。

Illegitimate child claim system is in the realm of paternity law established an important system of the parent child relationship between children and their biological parents born out of wedlock,but the marriage law of our country has not yet confirmed this system.In order to improve China＇s family law system and protection of unmarried children born to the legitimate rights and interests,China should be in reference to the relevant legislation of foreign countries and regions based on constructing their unmarried children voluntarily claim system.
