基于政府管理视角的大数据环境下个人信息保护问题研究

Research on the Issue of Personal Information Protection in the Big Data Environment Based on the Perspective of Government Management

当前大数据环境下的个人信息保护是社会关注的焦点问题,解决好该问题对于保障公民合法权利,促进大数据产业健康发展具有十分重要的意义。本文基于政府管理的视角,从法律法规体系、全流程的监管体系、跨境数据流动处理以及多元治理机制等不同方面,分析了我国政府在应对大数据环境下个人信息保护问题中存在的管理问题,并通过借鉴具有典型代表意义的美国和欧盟在处理该问题上的经验,提出了相应的改进建议,以及促进大数据环境下个人信息保护的对策。

Nowadays, the issue of personal information protection in the big data environment has become the focus of the whole society. Solving this issue is of great significance in safeguarding citizens＂ legal rights and promoting the healthy development of big data industry. Firstly, based on the perspective of government management and from four aspects which include laws and regulations system, the whole process supervision system, cross - border data flow processing and multi - collaborative governance system, this paper analyses the outstanding govern- ment management problems of personal information protection in the big data environment in China. Secondly, this paper summarizes the successful experience of dealing with the personal information protection issue in the U.S. and EU. Finally, the paper puts forward the countermeasures about how to improve the government man- agement and solve the personal information protection issue in the big data environment.
