The Definition and Supervision of Public Officers' Discourse Power on Behalf of the Exercise of Authority in the Context of Ruling by Law

在依法治国的背景下,依法约束公职人员信息传播行为具有重要意义。本文首次提出"代语权"的概念,并从法律和纪律角度对"代语权"做出了明确界定,梳理了现行法律和纪律文件对代语权的约束性规定,对代语权滥用进行了分类,并从法律角度和行政管理的角度提出了代语权滥用的危害和加强代语权监督的现实对策。

Restraining the public officers＇information dissemination behavior plays an important role in the context of ruling by law. This paper proposes a concept of ＂discourse power on behalf of the exercise of authority＂ for the first time, carding restrictive provisions about discourse power on behalf of the exercise of authority in legal documents, sorting the discourse power on behalf of the exercise of authority, analyzing the harm of abusing it and giving the way to strengthen the supervision of this power from the view of law and administration.
