摘要
国内法与国际法的二元体系不足以满足全球治理的需求。全球行政法超越二元体系提供了跨国规制的法律框架和全球治理的行政法范式,并且已在贸易、投资、安全、环境领域得到应用。中国高度参与全球治理,给予全球行政法的形成和适用以更多的关注和研究是有意义的。
The binary system of domestic law and international law is insufficient to meet the requirement of global governance. Whilst the beyond binary system of the global administrative law provides the legal framework of transnational regulation and the administrative paradigm of global governance, which is already applied to fields of trade, investment and security as well as environment. Therefore, it is of significance for China to highly participate into the global governance and to pay more attention and study on the form and application of the global administrative law.
