Study on Incidental Review on Normative Document in Administrative Litigation

新修改的《行政诉讼法》规定了规范性文件附带审查制度,其重要性毋庸置疑。但这一制度如何设计和构建,现有的研究存在很大不足。规范性文件附带审查制度的设计应从请求条件、审查范围、标准、方式,以及审查后的处理出发,完成科学的、有效运转的制度构建。

Incidental review on normative document has been prescribed in the newly amended Administrative Litigation Law, which is of great significance. However, more emphasis should be put on how to design and construct such a system. Legal standing is the first of all in the construction. Then the scope, standard, mode of judicial review must be considered. The follow-up decisions are the last part of the design. The five aspects together constitute a functional and effective system.
