摘要
21世纪海上丝绸之路法律保障机制旨在为海上丝绸之路建设设置路线图,固定合作各方的权利和义务,增强合作的稳定性。这一法律保障机制的构建既需要处理好与现行多边、双边法律机制之间的关系,也需要国内法的支撑。因此,海上丝绸之路的法律保障机制应是一个多层级的、多主体参与的、国际法与国内法衔接、正式机制与非正式机制相结合的网络化体系。广东作为21世纪海上丝绸之路的重要枢纽应努力在该法律保障机制的构建过程中做出新的制度探索。
A legal regime is needed for drawing a road map for the construction of the 21^st Century Maritime Silk Road, and setting forth rights and obligations for parties in cooperation. The legal regime also needs to coordinate with the existing bilateral and multilateral legal regimes and national law. This paper argues that the legal regime for the 21^st Century Maritime Silk Road should be a multi-level and multi-actor network system consisting of international law, national law, binding agreements and nonbinding agreements.In constructing the legal regime, Guangdong Pilot Free Trade Zone should take an initiative in institutional innovation.
