高校教育管理中学生人格权受侵犯现状及保护对策探析

An Exploration about the Current Situation of the Offense of Students Dignity and the Protective Strategies in Universities

随着法治的不断进步,高校在教育管理学生的过程中侵犯学生人格权的事件日益显现,学生生命健康权、名誉权、隐私权、姓名权一类的案件在高校侵权案件中占多数,各类案件都有其不同的责任分担原则。导致此现状的原因是多方面的,高校管理权力与学生权利之间的冲突,相关法律法规的缺失,各高校制度的不完善及相关工作人员法律意识淡薄,缺乏正当程序约束等原因都可能会导致学生的人格权遭受侵犯。为此,建立高校权力与学生权利的平衡机制、完善高校管理法律法规、增强管理者法律意识等方式可以有效保护学生的人格权。

With the continuous advancement of the rule of law, the cases become increasingly apparent that colleges and universities many times violate students＇ personality rights in the process of educating and managing their students. Scattered among those infringement cases are students＇ life and health rights, reputation rights, pri- vacy rights and name rights. They constituent the major infringement cases of colleges and universities and each kind of the cases has its own principle of shared responsibility. The reasons why their management behaviors violate students＇ personality rights lie in several aspects such as the conflict between universities＇ management power and students＇ rights, the lack of relevant laws and regulations, imperfect systems in colleges and universities and weak awareness of related staff and the lack of due process constraints, etc. All those factors may contribute to the in- fringement of students＇ personality rights. Thus, a balance mechanism between universities＇ power and students＇ rights should be established. The improvement of university management laws and regulations as well as strengthe- ning staff＇ s legal awareness can also work well in the protection of students＇ personality rights.
