摘要
随着中国经济的高速发展,环境安全方面的矛盾越来越突出,尤其是重大环境风险的发生,严重影响了社会的安全稳定,甚至影响正常的经济社会发展。因此,有必要对经济社会发展中不断引发群体性环境事件的重大环境风险展开研究。在风险社会视阈下,重大环境风险具有"人为性"、"主观建构性"、"损失的后果和途径不确定性"等特质。然而,对于重大环境风险的规制,传统行政法学原理所主张的以确保干预的确定性和有限性为思路的行政法治方案已无法有效应对,为此必须构建一个以程序为中心,以环境信息公开、公众参与、环境行政公益诉讼为主要内容的新的行政法制方案。
With the rapid development of China economy, environmental safety aspects of the contradiction is more and more prominent, especially the major environmental risk occurs, the serious influence the security and stability of the society, and even affect the normal social and economic development. Therefore, it is necessary for economic and social development in the constantly developed environment of major environmental risk. Under the perspective of risk society, major environmental risk is "artificial", "subjective constructiveness", "the consequences of loss of and approach the uncertainty" and other characteristics. For this, for major environmental risk regulation, the traditional administrative law theory advocated to ensure that the intervention of certainty and limited to ideas of administrative law have been unable to effectively cope with, and have to build a program centered, environmental information disclosure, public participation, environmental administrative public interest litigation as the main content of the new scheme.
