Thoughts on the Duties, Relationships and Powers of the Party Discipline Inspection

党的纪检工作担负着"监督"和"协助"双重职责,由此决定了党的纪检工作"双重领导"体制。在"双重领导"下,上下级纪委是领导与被领导关系;同级党委与纪委既是被监督与监督关系,又是领导与协助关系;上级纪委与下级党委为指导与被指导关系。在"双重领导"下,应以方便纪检工作职责落实为原则、以各自所负有的职责范围为边界、以人事财权为重点划分上级纪委与同级党委在纪检工作中的领导权;以党委的全面领导、主体责任和纪委的协助、监督责任为原则划分同级党委与纪委在党风廉政建设和反腐败工作中的职权;同时,纪委作为党内监督专门机关,还应该拥有了解情况、工作检查、专题调查、受理申诉、查处案件和工作保障等必要的权力。

The two duties of the discipline inspection of the Party are inspection and assistance, which lead to the ＂double leadership＂ system of the discipline inspection. According to this system, the relationship between different levels of the com- missions for disciplinary inspection is leading and being led; the relationship between the same level of the commissions for disciplinary inspection and the same level of the Party committees is both inspecting and being inspected and leading and as- sistance. Based on this system, apportioning the powers of different levels of the commissions for disciplinary inspection and the same level of the Party committees should take into account the following factors： convenience of the discipline inspection, scopes of respective duties, core powers of human resources and finance. The apportioning of the powers of the same level of the commissions for disciplinary inspection and Party committees should take the following factors into account： leadership of the Party Committee, responsible entity and duties of assistance and supervision of the commissions for disciplinary inspection. In addition, as a special inner-party inspection organization, the commissions for disciplinary inspection should have the powers to know the truth, to examine work, to investigate special cases, to receive complaints, to treat cases and to have warranties in work
