摘要
与《中华人民共和国立法法》只能推论出社会团体、企业事业组织以及公民有提出法律解释的建议权不同,有关专家起草的《中华人民共和国宪法解释程序法(专家建议稿)》明确规定这些组织及个人有宪法解释的提起权,其第十一条规定了个人请求的条件,即宪法诉愿制度;但这并非赋予他们在具体审查性解释和抽象审查性解释中的提请权。准司法化应是我国目前宪法解释的发展方向,通过司法途径将民间的活力纳入国家机关体系,是克服官僚主义的根本之道,也是激活宪法实施制度最简便、最有效的措施。
Inferring from the regulations of Law on Legislation,we could come to the conclusion that the social groups, enterprises,institutions or individual citizens have the right to make a suggestion about the legal inter- pretation. However, the Proposal Drafted by the Experts clearly stated that the above organizations or individu- als have the right to constitutional interpretation proposals. And article 11 of the Proposal regulated the condi- tions of individual application, which is the mechanism of constitutional complaints. On the other hand, this mechanism doesn' t confer the submitting power of interpretations on them in the abstract review or concrete re- view. The development of our constitutional interpretation should follow the path of quasi -judicialization, which is to institutionalize the individual applications through the channel of judiciary. This is a fundamental method to exclude the bureaucracy and the most efficient and simple way to activate all the mechanisms of constitutional enforcement.
