摘要
PPP模式在我国公共基础建设领域已被广泛采用。其性质可以与第三部门崛起、民营化、特许经营或授权的对比中表现出来。在运用过程中,PPP模式也遇到一系列公法风险,其中包括国有资产流失、加重腐败、行政不作为等现象,也有资本趋利性带来的弊端和公民参与权的削弱等社会问题。以上风险可以通过实体和程序两方面的手段加以规避。
PPP model in our field of public infrastructure has been widely adopted. The nature of the PPP model can rise with the third sector,privatization,franchising or authorized comparative performance in it. It also encountered a series of public law in the process of applying risk,including loss of state assets,increased corruption,administrative omission,etc. at the national level,there are also social benefits or reduce the risk of capital evils and weaken citizen participation right and so on. Above by means of risk aversion can be both substantive and procedural aspects.
