论法律解释在法律文本翻译中的运用

随着中外法律文化交流的日益频繁,世界各国的法律文本不断地被翻译成中文,大量中文法律文本也被不断地翻译成其他国家的语言文本。由此,法律文本翻译的失真问题成为中外法律文化交流不畅的主要原因之一。在当前法律翻译理论研究中,学者们更多地关注于语言学理论和翻译学理论的研究,少有人关注法律解释学理论在法律翻译中的指导作用。虽然法律翻译有其自身的特性,但法律解释与法律翻译之间具有共同的渊源。法律解释理论对于译者在翻译法律文本中正确理解原文本意大有裨益,将法律解释学的文义解释、目的解释、历史解释、系统解释等方法运用于法律文本翻译中,有助于化解法律翻译失真问题。

With the increasingly frequent communication between Chinese and foreign legal cultures, the legal texts of the world are translated into Chinese, and a large number of Chinese legal texts are translated into other languages. However, the distortion of the legal text translation has become one of the main obstacles to the exchange of Chinese and foreign legal culture. In the legal translation theory research, scholars have more attention in linguistic theory and translation theory research, little attention has been paid to the guiding role of the theory of legal hermeneutics in legal translation. Although legal translation has its own characteristics, there is a deep source of legal interpretation and legal translation. Legal interpretation theory is helpful to the transla-tor for solving the distortion.
