母乳具有物理上的独立性,能够与其他的物相区分。依据不同的物的分类学说对母乳进行定性分析,可得出母乳具有非人格性,是游离与生命物格和一般物格之间的一种特殊的物格。因此母乳属于特殊的物的形态,对其处置应从对象、管理、费用等方面规定特殊的规则予以规制,以符合社会伦理道德要求、维护文明社会秩序。

The breast milk is a liquid that is secreted out of the body of a woman in the lactation period. It is of physical independence and it can be distinguished from other objects. According to the classification theory of different species, it can he concluded that breast milk is not personality, and it is a special kind of property free from the life personality and general personality. Therefore, the breast milk is a special form of the material, its disposal should be subject to the object, management, fees and other special rules to regulate, in order to comply with social ethics moral requirements, maintain social order.
