摘要
为保证线人积极地配合警方开展侦查活动,提供有价值的线索,在涉及线人的犯罪案件中,经过对线人犯罪行为的危害性、线人工作环境的复杂性、线人协助侦破案件的重要性等因素的认真分析与思考,法律最终对线人的犯罪行为做出让步,赐予线人一个改过自新的机会,豁免他们的罪行,减免他们的刑事处罚。在对线人进行刑事豁免的同时,必须保留对线人追诉权的行使,针对线人在协助案件破获的过程中,超越社会容忍底线的行为进行处罚,避免法律的善意让步异化成法律惩治的漏洞。
To ensure the informant actively cooperate with the police to carry out investigation and provide valuable clues, after careful analyzing and considering the harmfulness of informant＇ s crime, the complex working environment of informant and the importance of informant＇ s assistance in cracking the case, the law finally made concessions on informant＇ s crime and gave them a chance to mend their ways and exempt from their crimes, ease the criminal penalty on them. In the meanwhile, prosecution exercise to the in- formant must be retained. Behaviors beyond society＇ s tolerance line should be punished so that good will of law alienated into the loop- hole of legal punishment.
