From the Fuzzy Text to Vivid Practice——Dilemma and Resolution of the Juvenile Investigation System

增设未成年人社会调查制度是2012年《刑事诉讼法》修改的一大亮点,但作为一个新兴概念,囿于立法技术不足,当前的法律文本尚存在缺憾,以致该制度在实践中运行较为混乱,故必须对其启动程序、适用主体、调查事项等做出更加细致的规定。同时应当准确区分刑事诉讼中的自向证明和他向证明,从而划定未成年人社会调查报告作为定案参考和办案依据的两种功能属性,进而分别设置相应的审查方法。

Juvenile investigation system is a highlight of amendment of criminal law in 2012 , but it is also constrained by lack of legislation technic ,defects in the current legal texts ,which cause certain chaos in the judicial application . Thus , more detailed provisions must be made in its procedure , its application subjects ,and investigation items . At the same time self‐oriented and other‐oriented evidences should be accurately distinguished in the criminal proceedings so as to delimit the two functional attributes of the social investigation system as the final reference and the basis of case , and set up the corresponding censoring methods respectively .
