社会整合视域的我国法治行政问题与策论

The Problem and Strategy in China's Current Administrative Law Based on the Perspective of Social Integration

重塑政府社会整合能力,凝聚合力,确保公平正义的社会秩序,是当代中国国家治理的重大课题。国家治理实践表明,一个以市场为主导的开放社会,法治行政业已成为社会整合的必然逻辑。然而,现阶段,权力本位而非权利本位的法律观、位阶法律冲突、行政执法行为市场化以及权力滥用等违背法治行政的问题,已严重影响政府进行社会整合的有效性与权威性。因之,我们亟需培育以法治精神为核心的行政价值观,实现法治从"治民"到"治官"的转换;确定行政立法权力边界,避免立法机关对行政立法授权的"一揽子"授权模式;推进行政机构组织和职权的法定化,坚守"法无授权即禁止"及"程序正义"原则;建立全方位、多层次、强有力的行政监督网络体系,为政府社会整合提供价值支撑、制度支持和组织保证。

With China＇s interest structure splitting up suddenly at present, a variety of forces are to participate in State governance in different ways and make various interest demands based on their own requirements. Reinventing government＇ s social conformity ability and cohesive force to ensure the social order of fairness and justice has become a major theme of China＇s state governance. The practice of state governance shows that administration of law has become the inevitable logic of social integration in the opening of a market-oriented society. At present, however, power-oriented view of law are not the right standard, while the conflict of legal hierarchy, the marketing action of administrative law enforcement and law issues such as abuse of power have seriously affected the effectiveness and authority of government＇s social conformity, we desiderate to cultivate the administrative values taking spirit governed by law; achieve the conversion from ＂mastering people＂ to ＂administer officials＂ ; determine the border of administrative legislative power to avoid the ＂package＂ authorized mode of legislature on administrative legislation authorized; advance the legalization of administrative institutions organization and terms and guard securely the principle of ＂law without authorization is prohibited＂ and ＂procedural justice＂ ; establish full-range, multi-level and powerful administrative supervision network system for government＇s social integration value support, system support and organization guarantee.
