The Study about Chinese Abortion Approval Policy and Resolution Mechanisms——Based on the Perspective of Policy Conflicts

我国规定符合生育条件的孕14周的妇女禁止非医学需要终止妊娠,因医学需要终止妊娠需经出生地和所在地计生部门的审批。这种政策与我国既有的计划生育政策、行政许可法、妇女权益保障法以及社会现实等产生了冲突。可以尝试从价值引导和政策协商、利益协调、信息共享等方面入手,逐步消解我国"人流审批"的政策冲突,切实维护妇女权益,体现公共利益。

Chinese government made a policy which says that 14 weeks pregnant women who meet the conditions of giving birth to babies are forbidden to get an abortion without any medical needs .They have to get a approval certificate from the department in the place where they were horn and where they live in case of the medical needs . This policy has been in conflict with Chinese Family Planning Policy, administrative licensing laws, Woman＇s Rights and Interests Protection Laws and social reality. The policy values guidance mechanism, consultation mechanism, department integration mechanism and information sharing mechanism, which can be considered to resolve the policy conflicts of abortion approval, safeguard the status of women and reflect the public interest.
