开放存取版权保护模式评析与反思

Evaluate and Reflect on the Copyright Protectiong Model of Open Acecess

随着数字网络技术的发展,社会公众期待利用新技术优势实现知识自由共享,而现有的版权法律制度限制了社会公众这种诉求。开放存取运动的兴起,给数字网络环境下的版权保护困境提供了一条新的解决途径,因而被许多学者认为是未来版权保护模式而被广为推崇。但对该模式进行深入研究后发现,由于该模式自身存在的缺陷,对其成为未来的版权保护模式的观点尚需商榷和反思。

With the development of digital network technology, the public expects to take advantage of new technology and achieve knowledge sharing at liberty, but the existing copyright law system restricts it. The rise of Open Access brings a new solution to copyright protection in the environment of digital network, which is considered as the copyright protection mode in future and widely praised by many scholars. However, we found that the mode is deficient after further study. The idea needs to be given more discussion and reflection.
