数字遗产分类定性与继承研究

Study on Categories to Property Analysis and Inheritance of Digital Heritage

随着互联网技术的迅猛发展,网络已悄然成为人们生活中不可或缺的重要组成部分,由此形成了新浪微博、腾讯微信和QQ、游戏装备、虚拟货币、帐号密码、文件视频等诸多虚拟数字财产,既有财产性利益,又包含精神性利益。数字遗产的属性、法律保护、继承等问题,都有待进行系统化研究。数字遗产能满足财产价值性、稀缺性和可支配性的特质,具有财产权的法律属性,是包含物权、债权、知识产权等权利的集合体,应纳入现有财产权利体系中予以保护;根据数字遗产是否具有明显的财产性的标准,可将"数字遗产"分财产性显著类、人格性显著类、财产性和人格性混合类三大类;不同类型的数字遗产应适用不同的继承规则规范,才有利于数字遗产继承纠纷的解决。

With the rapid development of internet technology, the network has become an important and indispensable part of people＇ s lives quietly ; therefore it has produced Sina Weibo, Tencent Wechat and QQ, game equipment,virtual currency, account passwords, files, digital video, and many other virtual digital property, which has property interest and contains spiritual interest. Digital heritage＇ s property, legal protection, inheritance and other issues, have yet to be systematically studied. Digital heritage and the aggregation includes property, debt, intellectual property, etc, which can meet value of the property, scarcity and dominant traits and should be integrated into the existing system of property rights. According to the standard, digital heritage can be divided into significant property class, significant personality class, property and personality mixed class. Different types of digital heritage should apply to different rules of succession;this is conducive to resolving the disputes of digital inheritance.
