论我国网络言论自由及其保护

On Freedom of Network Speech and Its Protection in China

言论自由作为宪法赋予公民的一项基本权利是一把双刃剑。随着技术的发展,互联网为言论自由提供了更为开放的平台,为人们提供了更加自由的表达空间,人们享受网络言论自由带来的快捷与方便的同时,也受到了网络言论自由的侵扰和伤害。文章在分析网络言论自由的特征及借鉴各国对网络言论自由管理经验的基础上,提出我国目前应当采取规范网络言论立法、加强政府对网络的管理、设置网络言论的边界等措施,进一步完善我国网络言论自由,以充分权衡网络言论自由的保护和限度。

Freedom of speech, as a basic right of citizens granted by constitution, is a double-edged sword. With the development of technology, the Internet provides a broader platform for freedom of speech and freer expression space for people. People enjoy the speed and convenience brought by freedom of network speech and simultaneously are intruded on and hurt by it. On the basis of analyzing the characteristics of freedom of network speech and using for reference the foreign management experience on it, this paper puts forward some suggestions for the improvement of freedom of network speech, such as regulating network speech legislation, strengthening the government＇s management of the network, setting up the boundaries of network speech in order to fully weigh the protection and limits of freedom of network speech.
