摘要
关于盗窃罪的犯罪对象在理论界一直争论不休。冒充房主将房屋出租给不知情的善意第三人的行为如何定性,理论界有多种观点,分别是构成盗窃罪、侵占罪、诈骗罪,非法侵入住宅罪,还有观点认为不构成犯罪,属于民事上的不当得利。根据我国的刑法理论和司法实践,在目前的刑法学法律框架下,此类盗用行为只能按无罪处理。然而,现实中此类案件发生频率和社会危害性均呈增长趋势,仅仅靠传统的民事制裁已经有些力不从心,将其引入刑法的规制范围刻不容缓,这需要修改现行的刑法条文,单独设立"使用盗窃罪"。
The object of the crime of theft has always been a hot issue in the theoretical circle. Actually the theorists have held different opinions on the nature of the behavior of posing as the house owner and renting the sto-len house to uninformed bona fide third party. It may be the crime of theft, the crime of embezzlement, the crime of fraud, the crime of illegally invading a residence or it may not be a crime, but just having the illegal profit. However, according to our country's criminal law theory and the judicial practice, this kind of embezzlement can only be defined as innocent under the current criminal law frame. As such cases are occurring thick and fast in the real life and more and more social harmfulness has been caused, the traditional civil sanctions seem inadequate. Therefore, we should immediately amend the current criminal law to establish the crime of"using the stolen house"so that the criminal law can apply to such behaviors.
