中国省域知识产权保护能力研究

A Research on the Ability of China's Provincial Intellectual Property Rights Protection

知识产权保护能力由立法保护能力、执法保护能力和影响能力构成,这三类能力递进形成了知识产权法律保护强度、现实保护强度和感知保护强度。文章构建省域知识产权保护能力指标体系,对省域知识产权保护能力进行测算。研究发现我国知识产权保护能力整体偏低,知识产权保护的影响能力低于立法能力和执法能力。省域知识产权保护能力与知识产权整体能力相一致,各地区立法能力、执法能力和影响能力的发展存在一定差异,三类能力的协调发展尤其是影响能力的提高是未来知识产权保护的关键。

The ability of intellectual property rights protection is constituted by legislative ability, law enforceable ability and influencing ability. These three kinids of ability gradually form legal protection strength, realistic protection strength and perceived protection strength. This article constructs an index system about the ability of provincial intellectual property rights protection and then calculates. The conclusion shows that the ability of China＇s provincial intellectual property rights protection is low. The influencing ability is less than legislative ability and law enforceable ability. The ability of provincial Intellectual property rights protection consistent with the overall ability of intellectual property rights. But there are some differences in the development of regional legislative ability, law enforceable ability and influencing ability. The coordinated development of three kinds of ability especially enhancing the influencing ability is the key to intellectual property rights protection in the future.
