摘要
王阳明惩贪治污的主要途径为致良知去贪欲、礼主刑辅治贪行、正心修德行廉政和奖惩并用治贪腐,其廉政思想体现了礼主刑辅、奖惩结合、教罚互用、恩威并重的特点,其惩处措施对惩贪治污、化民成俗和整肃吏制发挥了积极作用。但仅凭良知的道德自律或曰道德的软约束而缺乏制度的硬约束致其实效性减损,因而无法从根本上解决中晚明贪腐之颓势,因此德治软约束与法治硬约束应共同作用才能发挥最大效用,这对当今社会之廉政建设和治理体系和治理能力现代化具有启示意义。
Wang Yangming's incorruption thought includes suppressing desire for corruption with innate morality conscience,supervising corruption with Li,penalizing corruption with punishment rules,cultivating moral characters to construct an incorrupt government and combing awards and punishment to deal with corruption,which plays a positive role in punishing official corruption,and influencing people and forming custom. However,the moral discipline based on consciousness without systematic and rigid rules is not effective enough to address the severe corruption in the middle and late Ming Dynasty. It is suggested in the paper that the rule of morals should be combined with the rule of the laws,which has an important implication for incorruption construction,and the mode rnization of administration system and administration ability.
