电费收益权质押中的问题及防范措施研究

从相关核心概念及权利属性和电费收益权质押有别于其他权利质押方式2个方面阐述了电费收益权质押的基本理论;论述了当前我国电费收益权质押权的实施办法及其登记系统的缺陷,从对出质人增加限制性条件、登记缺陷补救措施、坚持审慎性原则、加强电费收入监管4个方面论述了如何加强管理、防止电费收益权质押过程中发生违约事件。

From two aspects of related core concepts and power properties and electricity usufruct pledge is different from the way of other rights pledge, this paper expounds the basic theory of pledge of electricity usufruct. We discuss the measures for the implementation and its registration system defects of our electricity usufruct pledge at present, and expound how to strengthen the management to prevent the occurrence of defaults in the process of the electricity usufruct pledge from the following four aspects： to increase the restrictive conditions to pledgor, to register defects remedial measures, adhere to the principle of prudence and strengthen the regulation of electricity income.
