高校体育运动专利申请现状与分析——基于全球学术机构专利的观察

Status Quo of Sports Patent Application in Colleges and Universities from the Observations of Worldwide Academic Institutions

以国际专利分类法中"运动、游戏、娱乐活动"领域专利为切入点,对全球学术机构中体育运动专利的时空发展特征、被引情况及法律状态、高产机构聚集及主要技术内容等进行分析。结果显示:我国学术机构尤其是高校已成为该领域技术创新的重要力量,同时也存在整体质量不佳、专利过期比例较高、机构间缺少合作、核心技术领域研究比重过低等问题。提出:调整专利申请激励机制,设立专利专职管理机构,加大前期评估与后期市场化运作,发展体育产业产学研合作模式,提升我国高校体育运动专利质量。

The study started from the patents in the fields of＂sport,game and entertainment＂based on the international patent classification to analyze the time-space development features,cited times,legal situation, high-production organization cluster and major techniques of sports patents in global academic institutions.The findings showthat the academic institution in China has played the leading role in technological innovation,although it has the problems that the overall quality is not high. Besides,there is a high proportion of expiration and lowproportion in the field of core technique research,plus the lacking in cooperation among organizations. The paper suggested that incentive mechanism of patent application should be adjusted by establishing patent administration agency; the pre-assessment and post-marketing operation should be enlarged; the industry-university-research model should be developed to promote the sports patent quality in Chinese colleges and universities.
