大陆与台湾言论自由权衡下的诽谤罪比较研究

Comparative Study of Libel Between China's Mainland and Taiwan From the Perspective of Freedom of Speech

近年来,诽谤罪骤然上升为社会热点问题,应该怎样平衡诽谤罪与言论自由,特别是媒体的言论自由引起了社会的广泛关注。文章运用比对大陆与台湾的诽谤罪法律实施及构成要件,梳理诽谤罪与言论自由的法理关系等方法来深层分析大陆已或易出现的实质问题,并提出相应解决的实用建议,以期有一定的理论与实践上的启发意义。

In recent years,libel suddenly has become a social hot issue. How to balance libel and freedom of speech has widely caused public concern. By comparing the legal practice and the components in China mainland and Taiwan, the legal relation between the two is discussed to analyze the essential problems in China. Practical suggestions are also made in this paper.
