摘要
《新消法》中第一次明确表示了消费者享有个人信息依法得到保护的权利。显然《新消法》对于个人信息的保护针对的是所有消费者,但是网络消费者因网络虚拟性等原因,当个人信息受到侵害时,请求救济的过程中会存在更多的困难之处以及与现实生活中的不同之处。为此,文章试图针对网购消费者在其个人信息受侵害后的民法救济做进一步的探讨。
It is defined,for the first time,that customers enjoy the right of protecting their personal information in the "New Consumer Law". Apparently, this protection covers all customers;however, the online shopping customers have more difficulties of realizing civil remedies in the case of personal information infringement. It attempts to explore the possibilities of practicing civil remedies after the online customers' personal information is abused.
