摘要
研究目的:对土地制度系统中的关键制度——土地登记制度与用途管制制度的制度关联性进行分析,揭示制度关联性对土地制度演进变革的影响。研究方法:比较研究法与理论模型法。研究结果:(1)土地登记与用途管制在生态用地与耕地保护方面存在明显交集,且具有不同的表现形式;(2)在不同的场域中,土地登记制度与用途管制的制度关联性特征不同;(3)土地登记制度与用途管制制度的演进绩效性质不同,并且制度关联性影响其演进。研究结论:制度关联性影响土地制度的演进或变革,土地制度改革时应当强调土地制度的顶层设计,关注土地登记制度与用途管制制度之间的关联性。
The purpose of this paper is to research the institutional relevance between land registration and use control, as well as revealing that how institutional relationship affects the institutional evolution. Comparative study and theoretical model method are adopted. The results show that 1)There are obvious intersection of land registration and use control in ecological land and agricultural land protection, and they have different expression froms. 2)In different domain of land, institutional relevance between land registration and use control has different institutional relevance characteristics. 3)The performance properties of the evolution of land registration and use control is different, and the institutional relevance influences their evolution. The paper concludes that the institutional relevance affects the land institutional evolution, so the land system reform should emphasize the top-down design of land system, and concern about the institutional relevance between land registration and land use control.
