我国网络游戏法律规制论析——以《网络游戏管理暂行办法》为例

2010年文化部出台的《网络游戏管理暂行办法》是迄今为止我国最重要的网络游戏法律规制文件。该部法律文件运行五年来,在唱响网上主旋律,推进依法规范网络游戏有序发展中发挥了重要作用,但其在法律效力的权威性、法律适用的规范性、法律执行的保障性以及保护青少年免于网络游戏中的暴力、色情等内容侵蚀、防止未成年人游戏沉迷和实现网游开发商、运营商经济效益和社会责任平衡等方面还亟待加强与完善。完善我国网络游戏法律规制体系,提高对网络游戏的治理能力迫在眉睫。

In 2010 the Ministry of Culture issued the＂Interim Measures for the administration of network game＂is by far the most important game of our country network of legal regulation of file.The Department of legal documents has run five years,sing the main melody in the Internet,to promote and standardize network game law play an important role in the orderly development,but in the legal effect of the legal authority,the applicable rules of law enforcement,security and to protect young people from network game violence,pornography and other content erosion to prevent minors,obsessed with the game developers,operators of online games and achieve economic and social responsibility of the balance has also urgently need to strengthen and improve,perfect our country network game system of legal regulation.It is urgent to improve the governance capability of network game.
