经济转型国家竞争立法变迁路径及对我国的启示——基于对俄罗斯、乌兹别克斯坦、越南竞争法的分析

The Enlightenment for China from the Competition Legislation and Following Reform Routes of Economic Transitional Countries——Based on the Analysis on Competition Laws of Russia,Uzbekistan and Vietnam

从中央集权的计划经济向市场经济转型的国家,非常注重竞争法律制度的建设。由于这些国家特殊的经济转型背景,竞争法律制度建设和发展呈现出了和本国经济体制改革同步并行的特殊轨迹。通过选取俄罗斯、乌兹别克斯坦和越南这三个各具特色的经济转型国家,分析其竞争法律制度的立法背景、立法特点及相似的法律构建变迁路径,以求为我国竞争法律制度的完善提供借鉴。

Countries transitioning from centralized planning economy to market economy all put much emphasis on the construction of competition law. Due to the special transitional economy background of these countries, the establishment and development of competition law manifest the trend of coinciding with the reform of domestic economic mechanism. This essay selects three typical economic transitional countries including Russia, Uzbekistan and Vietnam to analyze the legislative background, characteristics and reform route of their competition law, so as to provide reference for the improvement of China＇s competition law system.
