摘要
法律的部门特征和宏观特性造成我国法律及管理缺乏对临时用地和土地征用系统、详细的规定,致使在临时用地土地征用过程中涉及的使用主体、使用范围、签约对象、部门权限和使用权能等缺乏综合管理、统一标准。文章通过剖析土地产权制度、相关法律衔接和土地市场行为,揭示问题产生的根源,并建议通过建立城乡统一的土地产权制度,整合不同层次立法权限和内容,完善土地市场机制和内容建设等举措,规范我国临时用地管理和土地征用。
There's a lack of detailed regulation of temporary land use and expropriation in the legal and administrative system due to the characteristic legal departments and its macroscopic properties, which resulting in a lack of comprehensive management and uniform standards of main consuming body, range of application, signed objects, department authority and the right to use, also there're other issues in the process of temporary land expropriation. In this study, we reveal the source of problems through analysis of land property rights system, the relevant legal convergence and the land market behavior, then it's recommended that we should regulate the management of temporary land use and land expropriation by establishing a unified land property rights system, the integration of different levels of legislative authority and content, improving the land market mechanisms and its content construction, also with other initiatives.
