防控刑事错案,是检察机关实施新《刑事诉讼法》,贯彻党的十八届三中全会、四中全会精神的必然要求,是检察机关践行公正司法的必然要求,也是检察机关提升司法公信力的必然要求。然而,检察机关推进防控刑事错案的工作面临着诸多挑战,比如,如何适应以审判为中心的诉讼制度改革,如何协调严格执法、错案追究与内部考评的"左右挤压",如何实现指控的有效性与客观公正义务的有机统一,等等。加强对检察机关防控刑事错案的研究,具有重要意义。

The prevention and control of Criminal Misjudged Case,carrying out the spirit of Third Plenary Session and Fourth Plenary Session of the Eighteenth,it is the necessary requirement of the new Criminal Procedure Law was implemented by procuratorial organs,is also the necessary requirement of the procuratorial organs to carry out justice and to improve the credibility of the judiciary,However,the procuratorial organs to promote prevention and control of the misjudged criminal case is facing many challenges,for example,how to adapt to the reform of litigation system centered on trial,how to coordinate relationship of the strict law enforcement and misjudged case investigation and internal evaluation,and how to achieve the organic unity of the validity of charges and the duties of justice,and so on.To strengthen the research on the prevention and control of Criminal Misjudged Case of the procuratorial organs has vast significance.
