检察机关羁押必要性审查的实证考察——以A省为例

Empirical Survey on the Necessity Examination of Detention of Inspection Organ——A Case Study of A principle

通过对羁押必要性审查制度立法进行简要的梳理,指出了当前这一制度在实施过程中还存在重视程度不够、部门态度不一致、制度遗留难题较多等问题,并在总结羁押必要性审查工作经验教训的基础上,提出了相关部门应主动开展审查工作;要明确工作细节,完善系统流程规则,以及探索体制变革,修正逮捕制度的思路和举措。

The paper brief runs through the legislation on the necessity examination system of detention.It points out some existed problem while carrying out the system,such as lack of focus,differences between departments and multiple problems left behind by the system.Based on the experience concluded,it proposes some thoughts on reform and measures.
