摘要
我国工会体制的特殊性决定了我国集体协商机制从建立之初就与西方集体谈判制度存在完全不同的逻辑。西方国家的集体谈判遵循的是市场化和契约化的基本理念,而我国的集体协商则存在着较为明显的"逆市场化"特征。现有的集体协商是基于国情并借鉴西方折中式思维所形成的极具"中国特色"的集体谈判制度,其不仅存在一些违背常识的问题,而且实施效果也不理想。完善集体谈判制度应该按照集体谈判的本质要求,从构建企业与工会的平等地位、改变集体谈判主体与集体合同主体分离以及加强工会的责任体系建设等方面着手。
The particularity of our country's labor union system decides that our country's collective consultation mechanism exists entirely different logic from the western collective negotiation system at the beginning of foundation.Western countries' collective negotiation follows basic concepts of market principle and contract principle.However,our country's collective consultation exists obvious characteristic of "converse market principle".The current collective consultation is of great "Chinese characteristics" collective negotiation system formed by giving consideration to national conditions and referring to the west under this kind of compromised thought,which not only exists some problems that are against common sense,but also the implementation effect is not ideal.Improving the collective negotiation system should begin from aspects of constructing the equal status between enterprises and labor unions,changing the collective negotiation subjects' separation from the collective contract subjects,and strengthening the construction of labor unions' liability system according to nature requirements of the collective negotiation.
