法学本科生非诉讼实务能力的多层次培养体系探讨 被引量:7

On Multilevel Training System in Non-litigation Practice Ability for Undergraduates in Law Major

摘要 非诉讼实务能力的培养是目前法学本科教学中的短板,为了提高法律人才培养质量,建议遵循由浅入深、由易到难的顺序,建立起法学本科生非诉讼实务能力的多层次培养体系。在理念层面,教育者要用更宽广的视野来看待法律人才培养,重视对其法治思维和人文情怀的塑造;在"实训"层面,主要采取情景模拟教学等方式,使学生在课堂上初步体验非诉讼业务的流程与规则;在"实习"层面,建议充分利用现代信息化技术手段,拓展校外实习的范围与形式;在"实践"层面,建议采取"双师制"和"学徒制",使学生在真实工作环境下进行非诉讼实务的锻炼,并得到具有相应水平的导师指导。为保障非诉讼实务能力培养体系的效果,必须建立科学的评价指标体系,更多地考查学生分析问题的思路和过程,而不是最终得出的结论是否正确。 At present, the shortcoming in teaching undergraduates in Law major is non -litigation practice ability. In order to improve quality of legal talents, to follow the order from the shallower to the deeper as a result of establishing a multi - level training system for undergraduates in Law major in non - litigation practice ability is suggested. At first, the educators should have wider vision to treat talent training in Law, and their legal thought and personality should be paid more attention on the conception level. On the level of "Training", the virtual teaching Model should be applied to let students experience primary of the procedures and rules of non - litigation. On the level of "Internship", expanding the scope and form from outside and fully utilizing modern information technology are recommended. On the level of "Practice" ," double - teacher system" and "apprentice system" to make students exercise non - litiga- tion proceedings under real environment are proposed, to get guidance from eligible supervisors. At last, a scientific evaluation index system must be established to ensure the effect of non - litigation practice ability system, which focuses on the thinking and process in analyzing but not the conclusion.
