摘要
作为环境纠纷的重要类型,预防性环境群体性纠纷由环境风险引发,其状态变化可体现在潜在、表现、激化三个层面。通过考察行政机关、企业、利益相关公众、专家、司法机关、环保NGO在纠纷各个层面中的角色与功能,可以发现我国现行预防性环境群体性纠纷解决模式属于以行政机关为中心的单一对抗模式。随着环境纠纷的发展与我国立法改革的进行,此种模式已面临全面挑战。相较而言,多元合作模式有助于消除对抗性,更符合我国预防和解决预防性环境群体性纠纷的实际需要。
Preventive environmental collective dispute is an important type of environmental dispute.Its development can be divided into potential levels,performance levels and intensification levels.If we take the roles and functions of administrative agencies,enterprises,public stakeholders,experts,judiciary and environmental NGO as the variables,we can abstract that our current preventive environmental collective dispute resolution model is administrative agencies-centered unitary confrontation mode.In face of the development of environmental disputes and our legislative reforms,this mode has been plunged into a crisis of legitimacy.In contrast,multi-cooperation mode can eliminate confrontation,help our country to prevent and resolve preventive environmental collective disputes.
