论中美反腐败执法合作的利益诉求、困境与破解思路

The Interests Dilemma and the Solutions to Sino-US Anti-corruption Law Enforcement Cooperation

中美两国存在开展反腐败执法合作的共同利益诉求,但是,因为两国对反腐败执法合作内容的关切度存在分歧,具体的反腐败法律制度存在差异,美国对我国司法体制缺乏信任以及中方未能提供美方所需要的必要证据等原因,使得现有的反腐败执法合作机制成效不尽如人意。为此,中美两国应当在符合各自国内法律制度精神实质的前提下,转变反腐败执法合作观念,把反腐败议题提高到中美双边关系战略高度,增进两国反腐共识,改变对犯罪分子缉捕回国为异地追诉惩罚,追赃和追逃要双剑并举,并从机制上由注重惩罚转变为注重预防,进而强化两国国际金融、税务等方面的行政执法合作,建立追逃和追赃情报分享机制,增强两国反腐败合作的成效。

China and the U.S.have shared some common interests in anti-corruption law enforcement cooperation.Nevertheless,the existing anti-corruption law enforcement cooperation mechanism is not satisfactory because of differences in the content concerns of anti-corruption law enforcement cooperation and some specific anti-corruption legal systems between the two countries.China＇s judicial system lacks confidence from USA and fails to provide the necessary evidence to USA.To this end,the Sino-US cooperation should be in accordance with the spiritual essence of their domestic legal systems and change the idea of anti-corruption law enforcement.At the same time China should actively advance the original methods and explore into law enforcement cooperation patterns that accord with the actual anti-corruption needs.
