摘要 日本修宪是国际社会中的一个重大事件,有必要厘清其实质及其在国际法上的合法性问题。通过对日本修宪过程的梳理,认为日本修宪是要解构"和平宪法"所确立的战后和平体制。日本是国际法上的"非正常国家","非正常国家"是其履行众多国际条约义务以及承担相关战争责任的逻辑结果。日本推动旨在违反、否认、颠覆其承担的国际义务、责任的修宪活动,属于"非法"。日本的非法修宪活动,对二战后的国际和平秩序构成严重挑战。 Japan amending its constitution is an important event in the international society, so it's necessary to clarify the essence and the legitimacy of its constitutional amendment in international law. Through the examination of Japanese constitutional amendment process,it is thought that the essence of Japanese constitutional amendment is to deconstruet the postwar peace system,which was established by the pacifist constitution : Japan is an abnormal country in international law. The abnormal country status of Japan is the logical result of it to fulfill its international treaty obligation and to shoulder its war - related liability. Japan promotes its constitutionalamendment for the purpose of violating, denying, and overthrowing its international obligations and liabilities, belonging to be illegal. The illegal activities of Japan's constitution amendment are big challenges to international peace and order after World War II.
