摘要
我国目前的退市制度存在结构不完整、退市标准不合理、投资者保护缺失以及退市程序不正当等问题,应当在保护投资者利益、三公原则、宽进严出及提供周全便捷的法律救济的指导思想下,对退市结构、退市标准、重新上市、投资者利益保护以及退市程序予以完善。
The delisting system in the Chinese stock market is discussed.Deficiencies in current Chinese delisting system are detailed,including imperfect delisting structure,unreasonable delisting criteria,lack of investor protection and improper delisting process.The guidelines of improving the delisting system are proposed,which cover protecting investors’benefits,three-impartiality princi-ple,easy-entry and strict-exit and provision of comprehensive and convenient legal relief.Measures on upgrading the delisting structure,delisting criteria,relisting and investors’interest protection are advanced.
