摘要
海上防空识别区设置的合法性关涉国际关系、国际法发展,但目前设置防空识别区的国家均在某种程度上回避了防空识别区的合法性问题。海上防空识别区的合法性不能简单地归结于相关条约法的体系解释的结论,或者构成一种国际习惯,以及国家自卫权的实施。划设防空识别区属于一种创设国家权力(权利)的行为,此界定可有效解决防空识别区划设的权源问题,同时因其本身蕴含的平等性,可有力地反驳某些国家对我国的无理指责。与其他国家相比,我国防空识别区的划设体现一定的特殊性和复杂性,我国的具体实践可为相关国际法的生成与发展提供鲜活的素材。
Legitimacy of setting maritime air defense identification zone' s concerns international relations and the development of international law, but countries who have set maritime air defense identification zones all begged the question of legitimacy to some extent. Maritime air defense identification zone' s legitimacy can' t be simply attributed to the interpretation of treaty law system, or a kind of international custom' s construction, or even national jurisdiction' s implementation. Based on that setting maritime air defense identification zone is national practical, the justification for legitimacy should be built on state practice, through negotiations over the relevant treaties or more extensive experience to be recognized by the international community. China' s setting maritime air defense identifica- tion zone reveals different features from others, so that China' s specific conditions could provide living practice for international law' s formation and practice.
