虚假诉讼监督作为一项检察机关行使监督权的法律制度,是恢复公民受损合法权益、维护司法公平正义的有力武器。强化检察监督虚假诉讼职能,不仅基于虚假诉讼具有严重侵害利害关系人合法权益、浪费司法资源、损害司法的公信力和权威性等危害性,也是因为对比法院、受害当事人在识别、防治虚假诉讼遭遇的困境,检察监督虚假诉讼具有法理、职能等方面的优势。结合当前检察机关开展工作实际,可以从构建虚假诉讼线索发现机制、证据核查机制、整体协作机制、案件纠正机制、责任追究机制等角度强化检察机关对虚假诉讼监督,增强监督实效。

The supervision over false litigation,the legal system via which a procuratorial organization executes its supervision,is a powerful weapon to restore citizen's legitimate rights and interests,as well as to judicial justice. Strengthening the procuratorate's supervisory function over false litigation,not only in respect that the false litigation leads to malignant consequences such as a serious violation of the third parties' interests,a waste of judicial resources,a damage of judicial credibility and authority, but also in respect that the procuratorate's supervision over false litigation possesses absolute strength,compared with the court and the third parties. Considering the reality of current procuratorial pratice, it's necessary to build the false litigation clues foundation mechanism,evidence verification mechanism,coordination mechanism,case correcting mechanism,responsibility mechanism to strengthen procuratorial supervision of false litigation and enhance supervision efficiency.
