摘要
本案是一起医疗机构因使用非卫生技术人员从事医疗卫生技术工作而被卫生行政部门给予"吊销《医疗机构执业许可证》"处罚的典型案例。案由比较简单,但案情却相对复杂,涉及到使用非卫生技术人员、出租承包科室、超范围经营以及违反《药事管理规定》等问题。笔者对整个案件从行政违法行为追溯期、医疗机构出租承包科室认定、行政处罚办案时间延长、案件办理期限计算、民营医疗机构主体认定、文书送达、卫生监督约谈和行政处罚后回访等多个方面进行了详细的分析探讨,提出了很多观念,对卫生监督类似违法案件的查处具有借鉴意义。
This case is a medical institution due to the use of health technical personnel engaged in medical and health work and health administrative departments to revoke the" medical institutions practicing license" typical case of punishment,the cause of action is relatively simple,but the case is relatively complex,involving use non health technical personnel,rental contract department,super scope and the violation of multiple aspects of the pharmaceutical management provisions".The author of the case from the administrative illegal behavior back period,medical institutions rental contract department identification,administrative punishment handling time prolonged,the case for the period calculation,cognizance of the subject of private medical institutions,service of documents,health supervision interviews and administrative punishment after the visit.Surface were detailed analysis discussion,put forward a lot of ideas,to the hygiene supervision similar illegal case investigation has very good reference and guiding significance.
