首都社区矫正模式的实证分析与对策调整

An Empirical Analysis and Adjustment Measures of the Capital Mode of Community Correction

社区矫正作为一种非监禁刑罚执行活动,在刑罚人道化的大背景下,已经在我国取得了长足的发展。北京市自社区矫正试点工作全面铺开以来已有十年历程,在立足于本土化的十年探索中,北京模式已然取得很多成就,但也存在不少问题。在回顾过去,展望未来中,笔者通过对全北京18个区县的实地调研考察,总结出北京模式较之其他省份模式的独特与创新之处;并梳理出当前掣肘首都社区矫正工作进一步发展所存在的突出问题;最后立足于市情,以问题为导向,提出切实可行的本土化改善方案。

Under the influences of the humanitarian trend and as one kind of non-custodial penalty enforcement,community correction has undergone great development in our country.Since the pilot work spread to the entire capital city,Beijing community correction has been practiced for more than a decade.In this course,the capital mode has gained numerous achievements,and also has been confronted with some problems that call for solution.In this article,the authors summarize the innovations of Beijing community correction mode obtained through investigation of the 18 districts of capital city,analyze the main problems which hinder the further development of Beijing community correction,and finally offer a series of practical solutions under the current municipal circumstances.
