摘要
《侵权责任法》施行以来,医疗类人身损害案件通常表现为:案件数量增加、社会关注度高、诉讼数额虚高等特点。本文从我国医疗损害案件赔偿的特点入手,总结现阶段我国医疗损害案件赔偿制度存在的问题;并借鉴国外先进的医疗损害赔偿制度,对完善我国医疗损害赔偿制度提出可行性建议。
The cases of medical personal injury cases are usually characterized as the number of cases, the high social attention, the amount of the litigation, and the high number of the litigation since the implementation of the Tort Liability Act. The article summarized the existing problems of medical damage compensation system in Chi- na and improved our medical damage compensation system. The author proposed the feasibility of the proposal by drawing lessons from foreign advanced medical damage compensation system.
