摘要
分析了卷帘门窗耐火材料(特别是添加了甲基磷酸二甲酯的聚氨酯材料)的专利法律状态:1总授权率较低为23%,而且实用新型专利为主要授权专利;2前13名申请人授权率仅15%,专利申请人以个人为主,授权率因未缴年费较低;3授权数大于2件的IPC分类中,E06B9(主要是可卷式闭合装置)授权数5件和授权率33%最高;4公开5年以上的专利8项,授权有效的仅2项,公开10年以上的专利件数为39件,均失效。
The patent legal status for refractory material of shutter door and windows were analyzed,especially for adding dimethyl methyl phosphate to polyurethane material. The result showed that the total authorized rate was 23%,and the patent for utility model was used as the main authorized patents. Authorized rate of 13 before applicants was only15%,the applicant was given priority to individuals,and the rate of authorization was low for failing to pay the annual fee. In the IPC classification of the authorization number greater than 2 pieces,the E06B9( mainly can be volume type closing device) authorization number was 5 pieces with the highest rate of authorization 33%. Public patent more than 5years was 8 pieces,only 2 of these were authorization effective,there were 39 pieces opened for more than 10 years and were all invalid.
