第三方评估视野下的行政执行“中梗阻”治理研究

Governance of “Middle Obstruction”in Administrative Execution from the Perspective of Third Party Evaluation

行政执行"中梗阻"指中间层级的行政执行主体被动、消极、低效地执行公共政策,导致公共政策执行不畅,难以实现政策目标。而因其独立性、专业性和效率性,引入第三方评估不仅有利于行政执行的科学性和合法性、加强对行政执行的监督、避免寻租行为,而且有利于提升行政执行绩效。为促进第三方评估深入参与到行政执行过程中,有必要从政府、第三方和社会公众三个维度加以治理:完善第三方评估法律法规,实现政务公开,转变行政执行者的观念;提升第三方评估机构的独立性、科学化水平和评估能力;提高第三方评估的社会认同度和公众参与度。

＂Middle Obstruction＂ in administrative execution refers to the passive attitude or the inefficiency of intermediate executive officers, the subject and link of public policy implementation. It results from the officers＇ own reasons or consideration of individual interests, leading to obstructions in the execution of public policies and failure to achieve the objectives. Third party evaluation is carried out by non-governmental organizations. Because of its independence, professionalism and efficiency, these organizations have drawn the attention of the government, society and public. On the basis of analyzing the third party evaluation obstacles, we put forward the governance path for the government, the third and the social dimensions. It includes improving laws and regulations of the third party assessment, promoting openness of government administration, changing the concept of civil servants, enhancing the independence of the third party evaluation, scientific level and assessment ability, and advancing social recognition and public participation of the third party evaluation.
