摘要
客观归责如何在医师组织协助义务框架中得以适用,是困扰刑法理论及其实务的一道难题。在组织医疗分工行为中,为防止医师及其辅助人员出现技术性瑕疵之危险,医师必须有效履行组织与协调义务。若没有组织分工与彼此协调,而病人因此出现危害结果,相关医师就无法主张信赖原则并以此排除其行为客观归责之判断。
How the objective imputation in medical system can be used in vertical organization is a difficult problem in criminal law theory and practice. The application of the principle of reliance is analyzed during the organizational coordination. In other words, whether the behavior of doctors can meet the principle of reliance depends on the doctor's effective fulfillment of the obligation of organizational coordination. Based on the German medical criminal judicial practice, the author further discusses the obligations in the medical behaviors. The demarcation line between the specific situations of the objective imputation judgment and the principle of reliance is clearly defined.
