美国地方性图书馆法研究——以《犹他州图书馆法》为例

A Research on Local Library Laws of America — A Case Study of Library Laws of Utah State

我国目前尚无一部全国性的公共图书馆法,虽然我国已颁布了6部地方性图书馆法规和8部地方性图书馆规章,但这些法规和规章均存在诸多问题。美国犹他州图书馆法内容全面、操作性强,值得我国在图书馆基本法立法过程中加以借鉴。通过从经费、管理体制、图书馆员职业资格认证、馆际合作、文献资源建设、用户服务、图书馆安全方面具体分析美国犹他州图书馆法的内容,对我国图书馆法的制定可得出以下有益启示:图书馆法应是一个完整的法律法规体系;图书馆法应具有可操作性;立法后应不断修订完善;图书馆法应对经费的来源和额度做出明确规定;建立图书馆员职业资格认证制度;建立公共图书馆理事会制度;加强对弱势群体的援助。

There isn＇t a national public library law in our country. Our country has promulgated six local regulations and egiht local library rules,but these regulations and rules have many problems. Library Laws of Utah has many advantages such as rich content,strong operability,which is worthy of reference in the process of the basic law of library legislation of our country. From library funds,management system,professional qualification certification of librarians,interlibrary loan,literature resource construction,user service,and the library security,the paper analyzes the contents of Library Laws of Utah. We can get following inspirations from researching Library Laws of Utah to legislate national public library law： library law should be a complete system of regulations and rules; library law should be operable; library law should be continuously revised; library law should make clear provisions with the source and limitation of funds; a librarian professional qualification authentication system should be established; public library board system should be construded;protection to vulnerable groups should be strengthened.
